Terms of Service and End User License Agreement

Effective July 31, 2026

1. Eligibility and acceptance

You must be at least 18 years old and legally able to enter this agreement. You represent that the birth date and account information you provide are accurate. If you use HYiYH for an organization, you represent that you are authorized to act for that organization. Creating an account requires affirmative acceptance of these Terms and the Privacy Policy, and HYiYH may record the applicable policy version and acceptance time.

2. The service

HYiYH includes the website, iPhone and iPad applications, Apple Watch companion experiences, Cloud-backed account functions, Local-device functions, projects, folders, inputs, profiles, calendar, maps, chats, drawing, saved links and feeds, AI integrations, backup tools, device controls, camera or augmented-reality controls, and other present or future features. Features can vary by device, operating system, region, subscription tier, permissions, account status, provider availability, or technical capability.

3. Accounts and security

You are responsible for maintaining accurate account information, protecting your password and devices, and promptly reporting suspected unauthorized access. You may not share credentials in a way that defeats plan limits or security controls. HYiYH may require reauthentication, email verification, session revocation, password reset, or other reasonable security steps. You are responsible for activity performed through your authenticated account except where applicable law provides otherwise.

4. Memberships, the payment provider billing, renewal, and cancellation

Basic and Expert memberships may be offered on monthly or yearly recurring billing intervals. The price and interval presented in secure checkout govern the transaction. Paid memberships automatically renew until canceled unless the Checkout terms or applicable law state otherwise. Payment processing is provided by the payment provider. HYiYH does not receive or store your complete payment-card number.

Eligible plan changes, payment methods, invoices, and cancellation are managed through the payment provider's hosted customer portal when enabled. Cancellation generally takes effect according to the billing settings shown in the portal or Checkout. Except where required by law, App Store rules, or an express written refund policy, fees already charged are non-refundable. Taxes may apply. HYiYH may change future prices or plan features with legally required notice; changes do not retroactively alter an already completed charge.

5. Entitlements and App Store download access

The website may show an App Store download action only after the billing system reports a qualifying active or trialing membership. Access can be delayed while a payment, authentication challenge, webhook, or billing state is still processing. Downloading an app from the Apple App Store is also subject to Apple's availability, account, device, regional, and platform rules. A website membership does not guarantee that every device can install or run every feature.

6. Local Data, Cloud Data, synchronization, and backups

Some information can be stored locally on a device and other information can be stored through the configured Cloud-backed Cloud service. Local and Cloud records can differ temporarily because of offline operation, synchronization delays, conflicts, permissions, provider outages, or user choices. You are responsible for maintaining independent copies of information that is critical to you. Backup and restore tools reduce risk but do not guarantee that data can always be recovered.

7. User content and permissions

You retain rights you have in content you create or upload. You grant HYiYH and its service providers a limited license to host, process, transmit, transform, cache, back up, and display that content only as reasonably necessary to provide, secure, support, and improve the services you choose. You represent that you have the rights and permissions necessary for content you submit and that it does not unlawfully violate another person's privacy, intellectual property, publicity, contractual, or other rights.

8. AI and generated content

AI features can produce incomplete, outdated, biased, unsafe, incorrect, or fabricated results. You must independently review important outputs before relying on them. AI output is not a substitute for qualified professional advice, verified source material, or your own judgment. Do not use AI output as the sole basis for medical, legal, financial, employment, credit, housing, insurance, safety-critical, or other high-impact decisions. The optional Gemma workspace sends prompts only to the local or private-network model endpoint configured by the website operator.

9. Health, wellness, medical, and emergency limitations

Health, fitness, body, wellbeing, symptom, medication, biometric, nutrition, or activity information is provided for organization and informational purposes unless a feature expressly states otherwise. HYiYH is not a medical provider, emergency service, diagnostic device, or substitute for professional healthcare. Do not delay emergency assistance or professional care because of information in the service. If you believe there is an emergency, contact the appropriate local emergency service.

10. Financial, business, market, and crypto information

Business, analytics, pricing, market, investment, cryptocurrency, digital-asset, tax, or financial content is informational and organizational only. HYiYH is not acting as your broker, investment adviser, accountant, tax adviser, fiduciary, or financial planner. Markets and digital assets can be volatile and losses can be substantial. Independently verify information and obtain qualified advice before making financial decisions.

11. Maps, navigation, travel, transport, camera, AR, and physical-world safety

Maps, geocoding, routes, location pins, travel details, transport status, camera controls, augmented reality, measurements, spatial overlays, weather, and nearby information can be delayed, inaccurate, incomplete, or unavailable. Confirm road conditions, laws, dimensions, destinations, reservations, hazards, and safety-critical information independently. Do not use the service while driving or in any situation where distraction creates risk. Keep awareness of people, traffic, property boundaries, obstacles, and surroundings while using camera, AR, map, or Watch remote controls.

12. Third-party services

The service can interact with Apple, the payment provider, Cloud service, map providers, the configured local model service, websites, RSS publishers, email systems, hosting providers, analytics or crash services, and other third parties. Third-party services are governed by their own terms, policies, availability, and security practices. HYiYH does not control third-party systems and is not responsible for their independent acts, content, outages, pricing, policy changes, or security incidents except to the extent applicable law imposes responsibility.

13. Acceptable use

You may not use HYiYH to violate law; infringe rights; harass, threaten, exploit, or deceive others; distribute malware; conduct payment fraud; scrape or overload systems; bypass subscription, authentication, access-control, rate-limit, or security measures; probe for vulnerabilities without written authorization; access another person's data without permission; interfere with service operation; or use automated systems in a manner that imposes unreasonable load. HYiYH may investigate and restrict abusive behavior consistent with applicable law.

14. Intellectual property

HYiYH software, design, branding, interfaces, documentation, and service content are protected by intellectual-property and other laws. Except for rights expressly granted to you, HYiYH and its licensors retain their rights. You receive a personal, limited, revocable, non-exclusive, non-transferable license to use the service in accordance with these Terms and applicable platform rules.

15. Availability, maintenance, changes, and beta features

HYiYH may maintain, update, throttle, suspend, modify, replace, test, or retire features for security, provider changes, capacity, compliance, compatibility, repair, abuse prevention, or product development. Features may be unavailable in a particular region, device, browser, operating-system version, subscription tier, or account. Beta, preview, experimental, AI, and newly released features may be less reliable and can change without the same notice as mature features.

16. Suspension and termination

You may stop using the service and cancel eligible recurring billing through the available account tools. HYiYH may suspend or terminate access when reasonably necessary for nonpayment, fraud, unlawful conduct, material breach, security risk, abuse, legal requirements, or protection of users or infrastructure. Where appropriate and legally permitted, HYiYH may provide notice or an opportunity to cure. Some obligations survive termination, including payment obligations already incurred, intellectual-property provisions, disclaimers, liability limitations, dispute-related provisions, and rights needed to complete lawful data retention or deletion.

17. Disclaimers

To the maximum extent permitted by law, the service is provided "as is" and "as available." HYiYH disclaims warranties that the service will always be uninterrupted, error-free, secure, accurate, compatible, complete, or suitable for a particular purpose. No oral or written information creates a warranty not expressly stated here. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

18. Limitation of liability

To the maximum extent permitted by applicable law, HYiYH, LLC and its owners, officers, employees, contractors, affiliates, and licensors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, opportunity, goodwill, data, or business interruption arising from the service. To the same extent, aggregate liability for claims arising from the service is limited to the greater of the amount you paid to HYiYH during the twelve months before the event giving rise to the claim or USD $100. This limitation does not apply where applicable law prohibits it or to liability that cannot legally be limited.

19. Indemnity

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless HYiYH, LLC and its personnel from third-party claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from your unlawful use, your content, your transactions or representations to others, your violation of these Terms, or your violation of another person's rights. This obligation does not require indemnification for HYiYH's own conduct where prohibited by law.

20. Consumer rights, disputes, governing rules, and severability

Nothing in these Terms removes non-waivable consumer rights. Before filing a formal dispute, you are encouraged to contact support so the issue can be investigated. Any governing-law, forum, arbitration, or class-action restriction applies only if separately valid and enforceable for the parties and jurisdiction involved. If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions continue in effect.

21. Products, Marketplace listings, sellers, and transactions between users

The Products gallery can display goods or services offered by HYiYH or identified sellers. Marketplace listings can be submitted by users and can describe a person offering a service, a place or real-estate opportunity, a tangible thing, or an idea or event. Unless a listing expressly identifies HYiYH as the seller, HYiYH is not the seller, broker, employer, landlord, insurer, physician, contractor, escrow agent, carrier, or guarantor in a transaction between users. Buyers and sellers are responsible for verifying identity, authority, condition, ownership, licensing, permits, pricing, taxes, safety, legality, delivery, insurance, warranties, refunds, and the accuracy of representations. Never send money or sensitive information until you have independently verified the other party and the transaction.

22. Public content, profiles, sponsors, reviews, and moderation

Content you mark public may be indexed, copied, shared, or viewed outside your intended audience. You are responsible for public profiles, sponsor materials, product media, marketplace listings, reviews, contact details, and other public representations you submit. HYiYH may review, label, reject, restrict, remove, preserve, or report content when reasonably necessary for safety, policy enforcement, legal compliance, fraud prevention, intellectual-property claims, or protection of the service. Moderation is not a guarantee that content is accurate, lawful, safe, or suitable.

23. Web search, RSS, saved links, and third-party content

Search results, websites, feeds, links, downloads, and third-party content are controlled by their respective providers and can be inaccurate, harmful, deceptive, unavailable, or subject to tracking outside HYiYH. HYiYH does not endorse a result merely because it is displayed or saved. You are responsible for deciding whether to visit, download, purchase, rely on, or share third-party content and for using appropriate malware, privacy, and security precautions.

24. Calendar, chat, accounts, projects, canvas, and collaboration

Calendar views, reminders, messages, account references, project canvases, and collaborative information are organizational tools. Delivery, ordering, synchronization, and notifications are not guaranteed. Do not store passwords in account-reference fields, and do not treat a reminder or chat message as the only record of a legal, medical, safety, employment, financial, or time-critical obligation. Users are responsible for maintaining appropriate independent records and backups.

25. Administrator and support access

An account marked as an authorized administrator can receive feature access without a consumer subscription for operations, support, development, testing, or account administration. Administrator access does not waive these Terms, create ownership of user content, or authorize access to private information beyond permissions and lawful operational needs. HYiYH may revoke administrator status at any time and may audit privileged activity.

26. Changes and contact

HYiYH may update these Terms to reflect product, legal, security, provider, or business changes. Material changes may be presented on the website, in the app, by email, or through another reasonable notice method. Continued use after an effective update can constitute acceptance where permitted by law; new affirmative consent will be requested where required. Questions may be sent to contact@hyiyh.com.
